The New Civil Liberties Alliance (NCLA) has filed a federal lawsuit targeting former President Donald Trump’s recent tariff measures against Chinese imports, claiming they are unconstitutional and outside the bounds of executive authority.
The lawsuit, submitted in a Florida federal court on Thursday, alleges that Trump acted unlawfully by leveraging the International Emergency Economic Powers Act (IEEPA) to introduce a sweeping 54% tariff on Chinese goods, which includes a 34% addition to the already existing 20% levies introduced earlier this year.
According to Andrew Morris, Senior Litigation Counsel at the NCLA, the use of emergency powers to impose broad tariffs bypasses Congress’s constitutional authority over trade policy, violating the principle of separation of powers. The NCLA, a conservative nonprofit dedicated to defending constitutional rights, is representing Simplified, a Florida-based home products company directly impacted by the tariffs. The group is urging the court to halt both the implementation and enforcement of these new duties and to revert the tariff schedule to its prior state.
