Legal Tensions Escalate in Kano’s Emirship Dispute
Court Ruling and Contempt Warning
KANO – The legal battle surrounding the Kano Emirship has intensified as Aminu Babba Dan’Agundi, senior counsel to the 15th Emir of Kano, Aminu Ado Bayero, has issued a stern warning to the 16th Emir of Kano, Muhammadu Sanusi II. Dan’Agundi declared that if Sanusi continues to present himself as the Emir of Kano, he will face contempt of court charges.
Dan’Agundi, who holds the traditional title of Sarkin Dawaki Babba, made these remarks during a press briefing regarding the latest ruling from the Court of Appeal. He emphasized the necessity for all parties involved to adhere to the court’s directive, which mandates the maintenance of the status quo ante bellum—the legal position before the ongoing dispute arose.
Implications of the Court of Appeal’s Decision
According to Dan’Agundi, the Court of Appeal’s ruling reinforces that Aminu Ado Bayero and four other Emirs retain their positions in Kano State. He elaborated on the two key prayers in the legal proceedings:
- Injunction Against Enforcing Appeal Judgment: The court issued an injunction preventing the enforcement of the judgment in Appeal No. CA/KN/126/2024, which involves the Kano State House of Assembly and Alhaji Aminu Babba Mohammad Mustapha, pending an appeal at the Supreme Court.
- Mandatory Injunction for Status Quo Maintenance: The court ordered that all parties, including law enforcement and judicial authorities, uphold the status quo ante bellum, as established in an earlier ruling by Justice A. M. Liman on June 13, 2024.
Legal Consequences for Sanusi
Dan’Agundi underscored that should Sanusi disregard the court ruling and persist in identifying as the Emir of Kano, it would constitute contempt of court. He urged the government and security agencies to enforce the court’s directive, ensuring peace and adherence to the rule of law.
“The law is clear—until the Supreme Court decides otherwise, the ruling must be obeyed. If Sanusi continues to parade himself as Emir, I will take legal action against him for contempt,” Dan’Agundi asserted.
He further appealed to security agencies to uphold the rule of law in Kano State, emphasizing that stability depends on compliance with judicial decisions.
