Why the Judge Withdrew from the Case?
Justice Obiora Egwuatu of the Federal High Court in Abuja has officially recused himself from presiding over the lawsuit filed by the suspended Senator representing Kogi Central, Natasha Akpoti-Uduaghan. The judge’s decision, announced on Tuesday, was influenced by a petition from Senate President Godswill Akpabio, challenging his impartiality in the case.
The case was initially scheduled for hearing, but upon being called up, Justice Egwuatu delivered a brief ruling, declaring his withdrawal and directing that the case file be returned to the Chief Judge for reassignment.

Earlier, on March 4, Justice Egwuatu had issued an interim order restraining the Senate Committee on Ethics, Privileges, and Public Petitions from continuing disciplinary proceedings against Akpoti-Uduaghan. The committee had accused the senator of violating Senate rules, leading to her suspension for six months.
The judge emphasized that the disciplinary process should be put on hold until the court decides on the main suit, ensuring that Akpoti-Uduaghan’s rights, as enshrined in the 1999 Constitution (as amended), the Senate Standing Order 2023, and the Legislative Houses (Powers and Privileges) Act, were protected.
Court Orders and Senate’s Defiance
Justice Egwuatu mandated the Senate and its committee to justify why an interlocutory injunction should not be issued against their actions. He granted Akpoti-Uduaghan permission to serve legal documents through substituted means, including delivering them to the Clerk of the National Assembly or publishing them in two national newspapers.
Despite this court directive, the Senate Committee proceeded with its disciplinary measures, ultimately suspending the senator.
Following an appeal from the defendants, Justice Egwuatu later modified his interim order, allowing the Senate to continue with its activities while the lawsuit remained pending. This adjustment followed an argument from the Senate’s legal team, led by Senior Advocate of Nigeria (SAN) Kehinde Ogunwumiju, asserting that the court lacked the authority to intervene in Senate affairs.
