The Federal High Court in Benin City has delivered a significant ruling in favor of the Economic and Financial Crimes Commission (EFCC). On Thursday, Justice C.A. Obiozor dismissed a claim of ₦504.3 million in damages filed against the EFCC, following a sting operation carried out on May 23, 2023.

The case was brought before the court after individuals challenged the legality of the EFCC’s enforcement action, arguing that the agency overstepped its powers during the operation in Benin. However, Justice Obiozor ruled that the anti-graft commission acted within the scope of its constitutional mandate and therefore could not be held liable for the alleged damages.

According to the judgment, the EFCC’s investigative and enforcement powers under the law allow it to conduct such operations where there is credible intelligence regarding financial crimes, cyber-related offenses, or money laundering activities. The court emphasized that holding the commission accountable in this instance would weaken its ability to combat corruption effectively.

This ruling underscores the judiciary’s support for the EFCC’s anti-corruption mandate, reinforcing the agency’s authority to carry out sting operations where necessary. Legal observers noted that the decision sends a strong message about the balance between individual rights and the broader interest of combating economic crimes in Nigeria.

The dismissed claim of ₦504.3 million highlights the high-stakes nature of legal battles involving anti-corruption agencies. For many, the judgment also reaffirms the importance of Nigeria’s anti-graft institutions in the fight against financial misconduct, especially at a time when the country continues to grapple with economic challenges linked to corruption.

By dismissing the damages claim, the Federal High Court has once again affirmed that the EFCC’s actions, provided they are within the ambit of the law, remain valid and enforceable.
