Human Rights Lawyer Warns Against Egbetokun’s Extended Tenure
Renowned human rights lawyer, Hamza Nuhu Dantani, has raised serious concerns over the National Assembly’s recent amendment to the Police Act, which permits the tenure extension of Inspector General of Police (IGP) Kayode Egbetokun. Dantani argues that this decision, backed by President Bola Tinubu’s administration, could have far-reaching implications on Nigeria’s national security, police leadership structure, and public trust.
National Assembly’s Amendment Sparks Controversy
In a petition released on Friday, Dantani strongly criticized the National Assembly’s swift approval of the amendment, stating that it violates constitutional provisions and disrupts the existing police hierarchy. He labeled the decision as nepotistic, warning that it could demoralize officers awaiting promotion and erode confidence in law enforcement institutions.
Citing sections 7 and 18(8) of the Police Act 2020, Dantani emphasized that the IGP’s retirement age is clearly defined, and the new amendment contradicts these legal stipulations. He noted that Kayode Egbetokun, born on September 4, 1964, is set to retire by September 2024 upon reaching the mandatory age of 60 years or completing 35 years of service.
Amendment Undermines Rule of Law, Says Dantani
According to Dantani, the National Assembly’s amendment of the Police Act in favor of Egbetokun is a direct breach of the principle of equality before the law. He stressed that no police officer should remain in service beyond the legally stipulated tenure, warning that the decision could set a dangerous precedent for future administrations.
Furthermore, he criticized the speedy passage of the amendment by the National Assembly, led by Senate President Godswill Akpabio and House Speaker Tajudeen Abbas, stating that the move diminishes the checks and balances within the government. On July 23, 2024, both legislative chambers approved the amendment, allowing the IGP to serve out the full four-year term in his appointment letter, despite nearing the statutory retirement threshold.
Blocking Career Growth of Senior Officers
The controversial amendment to Section 18 of the Police Act 2020 has effectively halted the career progression of several high-ranking officers, as Egbetokun’s extended tenure prevents the natural leadership transition within the police force. Dantani pointed out that such a decision negatively impacts morale among officers and could stagnate the careers of junior officers awaiting promotions.
In his final remarks, Dantani urged President Bola Tinubu to prioritize merit-based appointments rather than favoritism, stressing that Nigeria’s police leadership should be built on competence and integrity, not personal affiliations.
